Overpayment Repayment Update: TRO

Thank you to all of the nurses that responded to the last update and participated by answering a few questions for our legal team. The information was very helpful!
On December 27, 2022 Danielle Franco-Malone, Counsel for WSNA, prevailed in the Pierce County Superior Court attaining a 90-day Temporary Restraining Order (TRO). The TRO prohibits CHI from making any overpayment repayment payroll deductions from nurses that did not authorize deductions or revoked their authorization in enough time before the December 30 paychecks were processed. We are also still pressing forward with the charges we filed with the National Labor Relations Board for bypassing the union in an effort to obtain the authorizations for deduction, and more. There will be more to come on this.
WSNA is disappointed VMFH has chosen to behave in this way when everything could have been managed in a collaborative and lawful manner. Nevertheless, this is the path they have chosen, and that is why WSNA leadership has and will continue to take every action available to protect and represent our members to the best of our ability.
If any WSNA member had deductions taken from their December 30 paycheck that were not authorized, please notify WSNA Nurse Rep Barbara Friesen at bfriesen@wsna.org and include a copy of the December 30, 2022 paystub showing the deduction, verification you never authorized deduction, or proof you revoked authorization.
